Contribution by KINDL/MAYERHÖFER to the „Festschrift“ Honouring Univ-Doz Dr Richard Soyer on his 70th Birthday

In their contribution to the commemorative volume, Dr Caroline KINDL and Mag Marc Julian MAYERHÖFER, LLM, LLM, examine diversion in judicial financial criminal proceedings.

Diversion has long been an established instrument of modern criminal justice. In judicial financial criminal proceedings, however, its potential remains largely untapped due to the current legal framework.

In their contribution, “Diversion for All in Judicial Financial Criminal Proceedings: A Proposal for Legislative Reform”, Dr Caroline KINDL and Mag Marc Julian MAYERHÖFER, LLM, LLM examine the existing restrictions on diversion and explain why they no longer meet the needs of a modern and efficient system of financial criminal law. The article also presents proposals for legislative reform aimed at broadening access to diversion.

The contribution has been published in the recently released Festschrift in Honour of the 70th Birthday of Univ-Doz Dr Richard Soyer, published by Verlag Österreich.
